Sen. Mark Kelly has now fired back at the Department of War’s statement, posting a photo showcasing a full spread of his military insignia, badges, ribbons, medals, and awards — the whole display. He declared he “will not be intimidated” and made a point of reminding Secretary of War Pete Hegseth of his own “service to this country.”
“If this is meant to intimidate me and other members of Congress from doing our jobs and holding this administration accountable, it won’t work,” Kelly wrote on X. “I’ve given too much to this country to be silenced by bullies who care more about their own power than protecting the Constitution.”

The Department of War on Monday released a bombshell statement confirming it is reviewing allegations of misconduct against Kelly (D-AZ), a former Navy captain, after he appeared in a video urging service members to defy orders from their superiors.
According to the department, Kelly’s actions are “serious,” and officials are weighing next steps. Among the possible consequences on the table: a court-martial. “The Department of War has received serious allegations of misconduct against Captain Mark Kelly, USN (Ret.),” the official statement begins.
Kelly — as our readers already know — didn’t act alone. He joined Sen. Elissa Slotkin (D-MI) and Reps. Chris Deluzio (PA-17), Chrissy Houlahan (PA-6), Maggie Goodlander (NH-2), and Jason Crow (CO-6) in a video urging military personnel and intelligence officials to defy so-called “illegal orders.”
Of course, none of them can point to a single “illegal order” that’s actually been issued. This was pure political theater — a group of Democrats flirting with encouraging insubordination inside the armed forces, all while pretending they’re just defending democracy. At worse, though, it smacks of sedition.
The problem here is obvious to anyone who’s ever worn a uniform: there’s a massive difference between a manifestly illegal order and one whose legality is merely debatable. Under the Uniform Code of Military Justice, service members cannot simply refuse to obey an order because it “feels” wrong or because they personally disagree with it. Doing so is itself illegal.
Yet that’s exactly what these Democrat lawmakers were encouraging — the idea that troops can just declare something like immigration enforcement “unlawful” and walk away. That’s not how the military works. That’s not how the chain of command works. And it’s certainly not how the UCMJ works.

The War Department does not directly reference the video, but refers to the UCMJ to outline the potential consequences Kelly may encounter.
“In accordance with the Uniform Code of Military Justice, 10 U.S.C. § 688, and other applicable regulations, a thorough review of these allegations has been initiated to determine further actions, which may include recall to active duty for court-martial proceedings or administrative measures,” the DoW noted. “This matter will be handled in compliance with military law, ensuring due process and impartiality.”
Further remarks from the Pentagon make it clear that the investigation definitely involves the video, reminding military retirees that they remain subject to the same laws that “prohibit actions intended to interfere with the loyalty, morale, or good order and discipline of the armed forces.”
“All servicemembers are reminded that they have a legal obligation under the UCMJ to obey lawful orders and that orders are presumed to be lawful,” the statement concludes. “A servicemember’s personal philosophy does not justify or excuse the disobedience of an otherwise lawful order.”
Unfortunately, thanks to this reckless stunt from Democrats, young and impressionable service members will now have to be reminded of the most basic principles of military duty — principles that should never have been politicized in the first place.
And now Kelly is staring down what looks like a serious investigation. Kelly — a former Navy pilot who absolutely knows better — was a key face in the video that Vice President JD Vance bluntly stated was “by definition illegal.”

You’d have thought he would know better.
Instead, Kelly proudly bragged that he was a “Captain in the United States Navy” before expressly (along with the other Dems in the video) accusing Trump of “pitting our uniformed military and intelligence community professionals against American citizens.”
They were very clearly urging service members and intelligence personnel to defy orders tied to immigration enforcement. And not just that — the message covered anything Democrats find politically inconvenient: cleaning up crime in blue cities, taking action against narco-terrorist vessels, you name it.
In other words, if Democrats don’t like the mission, they want troops to declare it “illegal” and openly defy their superiors. That is not how the military works. That is not how the chain of command works. And it is absolutely not how the United States handles national security.
Democrats essentially told uniformed service members: If it offends us politically, you should treat it as unlawful and refuse to do it.

This is an absolutely stunning miscalculation on the senator’s part. In trying to score a few cheap political points with the activist left, Mark Kelly may have just thrown his entire military legacy straight into the fire.
