It’s another day ending in “y,” which means yet another federal judge has stepped in to block the Trump administration.
On Monday, Judge Cameron McGowan Currie threw out the cases against former FBI Director James Comey and current New York Attorney General Letitia James, ruling that Attorney General Pam Bondi’s appointment of Lindsey Halligan as interim U.S. attorney for the Eastern District of Virginia was invalid.
The Justice Department is almost certain to appeal this ruling. And because the case was dismissed without prejudice, the charges can technically be refiled. But in Comey’s case, that may be nothing more than theoretical now — the statute of limitations has already run out, thanks to years of delays and legal wrangling that conveniently bought him time:
Why it matters: The decision is a major rebuke of the retribution campaign against Trump’s longtime enemy. Trump’s Justice Department had rushed to secure Comey’s indictment ahead of the statute of limitations that has since passed.
Driving the news: Judge Cameron McGowan Currie dismissed the case without prejudice, not clearing Comey from future prosecution on the charges.
Catch up quick: Comey pleaded not guilty to charges that he lied to Congress during a 2020 hearing and obstructed their proceeding.
NEW: A federal judge has dismissed both indictments against Tish James and Jim Comey after determining Lindsey Halligan’s appointment is unlawful. Unbelievable. pic.twitter.com/sPOgyu5iEO

My question is simple: where were all these judges when Donald Trump was being dragged through every courtroom in America by Alvin Bragg, Letitia James, and the Biden–Garland DOJ?
They were nowhere. They stood back, shrugged, and let the most aggressive, political, and unprecedented legal assaults on a former president roll forward without lifting a finger.
Comey has been whining that the case against him was driven by “retribution” and “spite.”
Please. If he wants to study retribution and spite, all he needs is a mirror. Few officials in modern American history have weaponized their office with more personal vendettas than James Comey.
This ruling is sure to jolt Washington, D.C., as we head into the Thanksgiving holiday — yet another example of the double standards baked into the system. We’ll keep you updated.
