Court Forces CIA to Hand Over January 6 Records the Agency Is Accused Of Hiding

A federal judge ordered the CIA to start producing January 6 records by November 16, 2026, after the agency tried to stall until 2027. Judicial Watch called it a win against years of cover-up.

A federal court has ordered the CIA to start handing over its January 6 records by November 16, 2026, dealing a serious blow to the agency’s shameless attempt to keep those documents buried until at least May 2027. The order came from U.S. District Judge Jia M. Cobb on October 15, and it’s the result of a Judicial Watch FOIA lawsuit that the CIA has been dodging since a March 2024 records request went completely unanswered.

The CIA’s legal strategy, if you can call it that, was to simply refuse to commit to a production schedule and then tell the court it would get around to things in late 2027. The judge wasn’t buying it. Her order notes that the agency at one point promised rolling productions would start no later than April 2025, then blew past that deadline without explanation, and then had the nerve to say it would just hand everything over in one batch nearly three years after the original request.

What exactly is Judicial Watch looking for? Records about CIA personnel deployed to Washington on January 6, 2021, shots fired inside the Capitol, bomb technicians, bomb-detection dogs, requests for CIA assistance, and after-action reports. This isn’t a fishing expedition. In March 2024, Judicial Watch already obtained 88 pages of ATF records through a separate FOIA lawsuit showing the CIA was absolutely there that day. Those records include text messages from something called the “January 7 Intel Chain” referencing “two CIA bomb techs” working a pipe bomb scene and CIA January 6 deployment records describing “several CIA dog teams on standby.” So the CIA was on the ground, and now it’s playing hide-the-ball with the paperwork.

Judicial Watch President Tom Fitton didn’t mince words. “Judicial Watch is pleased the court clapped back against the CIA’s utter contempt for the American people’s right to know what it was up to at the U.S. Capitol on January 6,” he said. “We look forward to finally getting documents next month, after years of cover-up.”

This is just one piece of a much larger Judicial Watch effort to pry the full truth out of a government that clearly doesn’t want you to have it. In July 2026, the group forced the release of over 1,000 hours of DC Metropolitan Police body camera footage from January 6. In June 2025, Judicial Watch secured a $4.975 million wrongful death settlement from the U.S. government on behalf of the family of Ashli Babbitt, the Air Force veteran shot and killed inside the Capitol by then-Capitol Police Lt. Michael Byrd. Babbitt was the only January 6 homicide victim. Judicial Watch has also sued the IRS over possible improper targeting of January 6 protesters and sued the DOJ over accelerated prosecutions following President Trump’s 2024 election victory.

The CIA now has until November 16 to start producing records. Given the agency’s track record in this case, Judicial Watch will probably have to drag them every inch of the way. But at least the court is no longer letting them pretend the calendar doesn’t exist.
