DOJ Just Filed More Charges Against People For That Thing Democrats Say Never Happens

Here we go again with that election thingy Democrats keep telling us isn’t happening.

The Justice Department announced charges Monday involving 16 noncitizens for illegal voting, fraudulent voter registration, and related election crimes. That follows 16 charged in late September and another dozen the week after. More than forty people in roughly two weeks.

For a decade the standard Democrat line has been that noncitizen voting is so vanishingly rare it isn’t worth legislating against — a bogeyman invented by Republicns to justify suppression. That claim was always doing double duty: it described a false reality and while also preventing anyone from actually looking into the issue. When there’s no verification, of course, then there’s also no detection, and when there’s no detection, you can point to the absence of cases as proof there’s nothing to find. Then somebody checks, and this is what turns up.

Look at one of Monday’s cases. Andrea Catanese, 60, an Italian national and lawful permanent resident, is accused of voting in the 2024 general election, then stating on his naturalization application that he had never voted in a federal election, then repeating that statement to the immigration official reviewing it. Not a confused resident who misread a form. A man who allegedly voted, understood it was disqualifying, and lied about it twice.

Everyone charged is entitled to a presumption of innocence, and it’s worth being precise: these defendants are lawful permanent residents, not illegal aliens. They’re here legally. They are also not citizens, and the franchise is the one thing that distinguishes the two categories. If a green card holder wants to vote in an American election, the path is open and well-marked. It runs through naturalization.

Now notice what Democrats have done with the evidence piling up in front of them. In August, when voter ID came to the Senate floor, not one Democrat voted for it. Last Wednesday, Senate Minority Leader Chuck Schumer (D-N.Y.), the poster child for term limits, blocked a bill pairing a national voter ID standard with a ban on congressional stock trading — killing both rather than letting either pass. A federal judge ruled last week that a law criminalizing noncitizen voting is unconstitutional. Mike Lee says tens of thousands of noncitizens have been identified sitting on state voter rolls.

Every one of these prosecutions is also an indictment of the system. Each defendant registered. Each was issued a ballot. In every case, the government that handed over that ballot had the means to verify citizenship and simply didn’t. The SAVE America Act would have required documentary proof at registration — the step that would have stopped essentially all sixteen of Monday’s cases before they became criminal referrals.

Senate Democrats killed it. Four Republicans who are more angry at President Trump than they are loyal to their constituents and the country helped. The lame-duck session after November is the last realistic window for this Congress.

The argument has shifted, and the other side hasn’t updated. It used to be “this doesn’t happen.” The Justice Department is now publishing names, nationalities, and case numbers on a near-weekly basis.

At some point, “rare” stops being an answer and starts being a confession that nobody was counting.
