Rep. LaMonica McIver (D-N.J.) announced she is pregnant this week and framed it as an act of defiance: she is facing 17 years in prison, she said, and she refuses to let this administration take her joy or her future.
Start with the number. Seventeen years is the arithmetic sum of the statutory maximums on three counts:

It is not a sentencing guideline, not a prosecutor’s recommendation, and not a realistic outcome for a first-time offender with no prior record. Everyone who has spent five minutes in a federal courthouse knows this. Invoking the theoretical ceiling as though it’s the expected result is how a defendant converts a prosecution into a persecution, and it works because most people don’t know the difference.

Now the part the number is meant to obscure. In May 2025, McIver went to an ICE facility in Newark alongside Newark Mayor Ras Baraka and Rep. Rob Menendez. What happened next is on video. Members of Congress shoving, obstructing, and making contact with federal officers while attempting to force entry into a secure federal facility. She was indicted on three counts. She has pleaded not guilty, no trial date is set, and she’s entitled to make her case to a jury.
Not the least bit crazy.

What she has already lost is the argument that she shouldn’t face one at all. Her lawyers claimed the prosecution interfered with her legislative duties — essentially, that a House seat comes with a pass for physical conduct toward law enforcement. In August, a three-judge federal appeals panel declined to toss the charges. That ruling is the significant development, and it deserved more coverage than any announcement since. There is no clause in the Constitution that lets a congresswoman put hands on a federal officer as part of the job.

Think about what the opposite holding would have meant. Every member who decided an agency was illegitimate would have license to physically obstruct its employees, with immunity attached. The agents in that building would have no recourse against the people who approve their funding and paychecks.

And notice the framing she’s landed on: that the Trump administration is consuming her life, taking her future. Nobody took anything. A federal grand jury reviewed evidence and returned an indictment for conduct she chose, at a facility she traveled to, captured on video. The officers on the receiving end also have families and futures, and they weren’t the ones who escalated.
Her defenders will call this political. It’s the opposite. The political outcome would have been declining to charge a sitting member of Congress because the optics are difficult. Prosecutors went forward anyway, and an appeals court let sided with them.
That’s what equal treatment looks like. It’s uncomfortable precisely because it’s rare. Mom-to-be or not, McIver should at least do some time. She deserves it, even if the kid she decided to use as a ‘get out of jail free’ card doesn’t.
