Anthony Fauci came to his Senate hearing with a team of lawyers, a security detail, an opening statement, and a strategy: read the prepared remarks defending his legacy, then invoke the Fifth Amendment 111 times on everything else. Walk out protected by Biden’s pardon. Accountability avoided.
Rand Paul isn’t accepting that outcome.
On Tuesday, the Kentucky Republican announced he is moving forward with a contempt of Congress resolution against Fauci — and the Senate Homeland Security and Governmental Affairs Committee, which Paul chairs, will vote on it Thursday morning. One day before the Senate leaves for recess.
The legal argument is the same one Paul laid out during the hearing itself — the same one Obama’s former Pentagon counsel Ryan Goodman acknowledged on CNN was legally sound. Biden’s pardon covers Fauci’s past conduct. A pardon removes criminal jeopardy. If there is no criminal jeopardy, there is no Fifth Amendment right to invoke. You cannot claim protection against self-incrimination when you’ve already been immunized from prosecution for the conduct in question.
Paul made this ruling from the chair during the hearing. He warned Fauci explicitly. He ordered him to answer. Fauci refused anyway.
“That is obstruction of a congressional investigation,” Paul said Tuesday. “The Committee will act accordingly.”
The opening statement issue compounds the legal problem. Fauci voluntarily addressed his pandemic record — gain-of-function research, COVID origins, his public statements — in his prepared remarks. By putting his version of events on the record, legal experts including Paul argue he waived any remaining Fifth Amendment privilege for the topics he chose to address. You cannot affirmatively testify about something and then refuse to be cross-examined about the same subject. The Lois Lerner precedent — established when the IRS official did exactly the same thing during the Tea Party targeting investigation — supports exactly this argument.
Fauci’s lawyers made a calculation: accept the reputational damage of 111 Fifth Amendment invocations rather than testify freely. That calculation only makes sense if there are gaps in the pardon’s protection — state charges from Florida’s now-open investigation, potential perjury exposure for statements made after the pardon, conduct outside the pardon’s explicit scope, or the unresolved autopen validity question that Trump himself raised publicly.
A man with nothing to fear from his testimony doesn’t plead the Fifth 111 times. He answers and goes home.
The Thursday committee vote doesn’t end the case. A contempt resolution goes to the DOJ for prosecution — and whether Todd Blanche pursues it, once confirmed, will be one of his first and most consequential decisions. Peter Navarro went to prison for contempt of Congress. Steve Bannon went to prison for contempt of Congress.
Anthony Fauci oversaw a pandemic response that killed more Americans per capita than any other developed nation. He hid his own vaccine-related pulmonary infarction while telling the public such reactions weren’t happening. He directed the destruction of government emails.
Thursday’s vote is the beginning of his accountability. Not the end.
