Less than 24 hours after Democrats secured a narrow victory in their redistricting plan for Virginia, a court correctly blocked the implementation of the new congressional maps, declaring both the referendum and the gerrymandered maps unconstitutional. This ruling is justified for various reasons.
However, the case will need to be reviewed by the Virginia State Supreme Court, which had previously chosen not to rule on the matter before the vote on April 21. Legal experts noted that the court likely made this decision to avoid intervention in case the referendum failed. Additionally, some experts commented that the Virginia Supreme Court has generally been reliable on procedural matters, giving opponents of the maps hope for a favorable ruling.
Are Democrats concerned that the Virginia Supreme Court might actually overturn their unconstitutional power grab? It certainly seems so, as House Minority Leader Hakeem Jeffries appears to be trying to intimidate the Virginia Supreme Court into upholding the new maps:

“The law is with us in Virginia,” Jeffries said. “The facts are with us in Virginia, and the people are with us in Virginia. There’s no basis in law or fact for the Virginia Supreme Court under the Constitution that exists, particularly in the aftermath of a people-approved referendum to allow it to move forward.”

Practically every word of that is a lie. Under Virginia law, Democrats were not allowed to bring forth a referendum once early voting for last year’s election had begun. However, they proceeded to do so anyway, despite the constitutional prohibition.
Just a few years ago, the people approved a non-partisan redistricting commission, which made Virginia’s electoral maps some of the fairest in the nation.
This situation highlights the very real dangers of “democracy.” We cannot have a society where a simple majority—one vote more than 50 percent—can make decisions for the remaining 49.99 percent without proper representation. In fact, our founders specifically rejected democracy and chose a representative republic for that very reason; they didn’t want a large plurality of the country legitimately disenfranchised, like Jeffries and his domestic terrorism party just did.
